Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, otherwise known as the General Regulation on data protection (hereinafter the “GDPR”) establishes the legal framework applicable to the processing of personal data.

As part of its activity, Cabinet Willaert implements processing of personal data bringing together the data of its clients and contacts.

​

No processing is implemented by Cabinet Willaert concerning customer and contact data if it does not relate to personal data collected by or for our services or processed in relation to our services and if it does not respond not to the general principles of the GDPR.

Any new processing, modification or deletion of an existing processing will be brought to the attention of customers and contacts by means of a modification of this policy.

The legal basis for the processing of personal data implemented is:

  • the legitimate interest pursued by the firm when it pursues the following purposes:

    • prospection and animation ;

    • management of relationships with costumers and prospects; and

    • organisation, registration and invitation to firm events.

  • the execution of pre-contractual measures or the contract when it implements processing for the purpose of:

    • the production, management and monitoring of its clients' files ; and

    • payment collection.

  • compliance with legal and regulatory obligations when implementing processing for the purpose of:

    • the prevention of money laundering and the financing of terrorism and the fight against corruption;

    • invoiving ; and

    • accounting.

Cabinet Willaert collects the data of its clients and contacts from:

​

  • data provided by the client or any partner as part of a file entrusted to the firm (client file);

  • business cards and emails ;

  • electronic sheets or forms completed by the client (payment sheet, post-conference satisfaction sheet);

  • registration or subscription to our online services (newsletter, website, social networks, etc.);

  • registration for events organized by the firm;

  • lists communicated by the organizers of events or conferences in which we participate;

  • exchanges via sovial networks ; and

  • échanges via the website www.cabinetwillaert.fr.

The firm only keeps the data for the duration necessary for the operations for which they were collected as well as in compliance with the regulations in force.

In this regard, customer data is kept for the duration of the contractual relationships increased by 3 years for animation and prospecting purposes, without prejudice to retention obligations or limitation periods. In terms of preventing money laundering and terrorist financing, data is kept for 5 years after the end of relations with the firm. In terms of accounting, they are kept for 10 years from the end of the accounting year.

Prospect data is kept for a period of 3 years if no participation or registration for firm events has taken place.

​The data processed is intended for authorized persons of the firm, as well as its service providers, in particular for the purposes of providing services ordered by the firm's clients.

The firm stores this personal data on its own server located in France, so that it benefits from the level of protection existing in this territory.

In accordance with the legislation applicable in France to the protection of personal data, namely the law of 6 January 1978 relating to data processing, files and freedoms as modified by subsequent laws (hereinafter the “Data Protection Act ") and the Regulation of 27 April 2016 relating to the protection of individuals with regard to the processing of personal data and the free movement of such data (hereinafter the "GDPR") (hereinafter together the “Applicable legislation”), any natural person representative concerned by this processing of personal data may, within the limits and conditions of the applicable legislation:

​

  • obtain communication and, where applicable, rectification or erasure of personal data concerning him;

  • obtain the limitation of the processing of their personal data;

  • object to the processing of their personal data;

  • obtain a copy of their personal data in a structured and common format for the purposes of transmission to another data controller; and

  • share their specific instructions on the fate of their personal data in the event of death; failing this, his heirs will be able to assert the rights they have under the applicable legislation.
